Hi, I got vaginal mesh erosion after the application of TVTO by my gynecologist in March 2019. After that, I consulted my gynecologist many times. She gave me many tubes to apply and many other oral medicines but no luck. I recently have seen on the internet that Vaginal Mesh is banned. Can I get compensation for my problem as I think these could be medical negligence? With regard Swati Arora |

Your concern is somehow correct, On April 16, 2019, the FDA ordered all manufacturers of surgical mesh intended for transvaginal application to stop selling and distributing their products immediately but your surgery was performed in March 2019. Another issue is that in India still vaginal mesh application like TVT, TOT or TVTO is going on and there is no strict guideline regarding the use of this mesh. The mesh erosion is a common complication and we don't think you will get any compensation if you file a case against the gynecologist. Medicolegal cases can only be filed if there is any negligence. Medical treatment can sometimes result in adverse consequences. But not all medical errors are caused by negligence, and such they are not all incidents of medical malpractice. In fact, it is estimated that only 37% of adverse medical consequences are due to medical malpractice. With regard Dr. R. K. Mishra |
