Dear Sir, My mother underwent Laparoscopy cholecystectomy in Jaipur 6 month ago. After 2 days of surgery she started developing Jaundice. Once the Serum Bilirubin was ordered by the surgeon after two days of surgery it was 4 (Four). The Laparoscopic Surgeon who has performed the surgery was not sure and he adviced one ultrasonography. The ultrasound report has shown that it was fuid collection around the diaphragm and in the gallbladder fossa. After 4 days of antibiotic course the condition of my patient became worst. Then I took the patient to Apollo Hospital, New Delhi. In Apollo they did the MRCP and pointed out that the patient has CBD injury. Now the doctor are suggesting Reconstructive surgery. I want to take this case in consumer court. This happens due to the negligence of the surgeon. Please suggest. |

CBD injury rate is 0.5% in laparoscopic surgery. Even the pioneer laparoscopic surgeon has damaged it so in this situation in My opinion there should not be a case of negligence against the operating surgeon. |

What he is saying that the operating doctor has not disclosed CBD Injury. It was detected at Apollo Hospital. Not informing the possible complication and keeping the patient in dark is a misconduct. He may proceed for compensation. |

There s no any single laparoscopic surgeon in the World who has not damaged the CBD. Inability of the surgeon to perform the maneuvers required for common bile duct palpation, an unstable patient, and local conditions in the porta hepatis that would make hazardous confusion due ti altered anatomy are the primary primary cause. Of course learning curve of the surgeon also play an important role but it should not be considered as negligence. |
