Dear Sir, I want to know that Court gives more credence to experience over qualification of a doctor. Suppose I am a surgeon and I have very high experience of doing gynecological surgery then can I perform gynecological surgery safely. |

Dear Dr.Khanna There is no such legal provision specifically mentioning that court should not give credence to qualification of doctor. The thing is that, for every post there is the requirement of a minimum qualification,those who posses that qualification are eligible for that post. After fulfilling the required minimum qualification the privilege should be given to the one who is having the more experience over the other, unless there is a provision contrary to it. Taking your example, If you are a gynecologist it means that you have the minimum required qualification to become gynecologist, otherwise you will not be authorized to perform a gynecological surgery.
