I have made an Injury report to the patient who came to my clinic a week ago. Patient was having fracture so I made the Injury according to that as Grievous Injury. Now the police is saying that this injury report is not valid and he is blaming me why I did not refer the patient to Government hospital. I want to get your advice that is it necessary to send the patient to Goverment Hospital if I can treat the patient. I am a MBBS Doctor with fully registered with MCI.

Dear Dr. Priyadarsha Gupta,

Every doctor have duty to start the treatment of the patient as soon as patient arrives at his clinic or hospital.In case of fracture it is not necessary to inform the police before starting the treatment, but if you are making a injury report then your duty starts towards the police. The injury report must be made in the prescribed format after informing the police, not doing this will attract your liability under section-201 Indian Penal Code.

So inform the police in future before making injury report, as injury report is an evidence in the court of law.
