Dear sir, We went Hon Kong in 2012 December for a holiday vacation and unfortunately there was a road traffic accident. My husband was admitted their in United Christian Hospital. They tried there best but we could not save him. Now they did postmortem and it was found little Alcohol in postmortem report. Now my insurance company is refusing me to pay insurance money and hospital is not giving me clear death certificate mentioning the cause of death. |

Dear Mrs.Chowhan, It is very sad to hear about demise of your husband. According to you, You have postmortem report, in which a little alcohol was found inside the body of your husband. If you have postmortem report with you then it is not necessary to have death certificate from hospital , the one you have is enough. Secondly as per the guidelines of IRDA(Insurance Regulatory and Development Authority)in their Medico Legal Manual(clause 4.3, sub- clause xxv)A insurance company is not liable to pay if the death is caused due to self injury, attempted suicide, or under the influence of alcohol(100-300 mg%) But you have not stated that whether your husband was driving himself or not. If not then you have fairly good chance to have the insured amount if driving in foreign country was not done by breach of law i.e without having valid international licence. According to International agreement the postmortem report of one country is acceptable and valid in another country. |
