Meri wife ki during delivery death ho chuki h. WO 7 month pregnant thi, last ultrasound me pta laga ki bacha dead h. Doctors be hame advice kia tha ki normal delivery karwai usse ho jayega. After 60 hours meri wife ko labour pain start hue and delivery k just baad doctors be bola ki coz of internal bleeding and cardiac arrest unki death ho gyi. Kya isme doctors ki galti h ki unhone turant operation krk baby deliver nai kia ya itne din tak baby ko womb me rakha ja sakta h coz doctors bol rahe the ki infection she bachane k liye WO antibiotics de rahe h. Dear Mr Atul Kumar It is very difficult to decide now what was the problem. However if there is error of judgement by doctor you can not do anything for that. Normally, a doctor is held liable for only his acts. However, in some cases, a doctor can be held liable for the acts of another person which injures the patient. The need for such a liability may arise when the person committing the act may not owe a duty of care at all to the patient or that in committing the act he has not breached any duty. A mere error of judgment occurs when a doctor makes a decision that turns out to be wrong. It is situation in which only in retrospect can we say there was an error. At the time when the decision was made, it did not seem wrong. If, however, due consideration of all the factors was not taken, then it would amount to an error of judgment due to negligence.
