Surgeon cut artery to liver

My husband had laparoscopic Para esophageal hernia repair. Surgeon cut artery to liver and did not notify patient and did not do any pro active treatment for the atrophy of lobe of liver.

Patient developed serious abdominal abscess with communication between colon and bilary tube. Infection was coming from atrophy of liver, but surgeon never told anyone and kept saying it was just a virus or maybe normal surgical fluid buildup. After nearly 4 months after surgery with weeks of antibiotics, the abscess was gone. However, the hernia repair has broken down and the stomach is again going through the hernia in the diaphram. Patient is 79 years old and active.

What should be done following the surgery if an artery has been cut to the liver and the live will atrophy? Should antibiotics or some procedure be done in a proactive way to prevent this massive abscess? Also, would the abscess compromise the hernia repair making it break down?

Liver is one of the organ in the body which can regenerate. Liver has many artery supplying blood and it is unlikely that abscess of liver is due to injury to the artery. However, the possibilities of abscess and infection could be due to hematoma developed due to injury of the artery. Actually the entire report has to be seen very carefully to draw any conclusion. Which artery of the liver was cut that also is necessary to know. Many time if small branches are cut liver get blood supply from portal vein.

You should also see the OT note of the surgeon and if he has recorded the video. Generally for laparoscopic surgeons it is mandatory to record the laparoscopic surgery and patient has right to ask for the video if any complication happens.

As far as failure of hernia surgery due to abscess is concern it is quite possible. The abscess or any infection decreases the strength of plication and para esophageal hernia repair fails.

Remember that these are the known complicatin of this kind of surgery. These complications are reported in books and Journals. This complication can not prove the negligence of the surgeon. However, you can fight for compensation from the hospital management and you can contact a good medico-legal lawyer to find out some technical detain of mismanagement in your treatment.
