My Sister Died Due to air embolism

Dear Sir/Madam

My sister whose age was only 43 year underwent laparoscopic hysterectomy 2 week ago and after 3 hour of the surgery she was transferred to ICU. After one day she died and doctors said that she developed air embolism during laparoscopic surgery and this is the cause of death. I want legal opinion that can I file a case for compensation. She was the only earning member of my family and now we are in great financial crisis.

Therapeutic attempts in ICU once the patient developed DVT can modify autopsy findings in deaths caused by Pulmonary embolism. These ICU management include vigorous resuscitation and use of thrombolytic medicines, which may partially disrupt or displace the embolism just before death. So in this case how the real cause of death can be establishing.

That is really interesting and important fact. It is also fact that if thromblytic agents will be found in serum than it is proved that a good diagnosis was established by laparoscopic surgeon and an attempt was made y hospital to save the life of patient and so laparoscopic surgeon is not done any negligence. The death due to complications is not the responsibility of a medical professional. If every death will make doctor responsible then every laparoscopic surgeon or every doctor has to stop their practice.
