Dear Sir/Madam

My sister whose age was only 43 year underwent laparoscopic hysterectomy 2 week ago and after 3 hour of the surgery she was transferred to ICU. After one day she died and doctors said that she developed air embolism during laparoscopic surgery and this is the cause of death. I want legal opinion that can I file a case for compensation. She was the only earning member of my family and now we are in great financial crisis.

Dear Katerina

Deaths resulting from pulmonary emboli are typical. The autopsy dissection, documentation, and ancillary studies regarding pulmonary emboli are important components of evaluating such fatalities and to rule out the negligence of the laparoscopic surgeon.

The detection of the saddle embolism at autopsy does not signify no more the investigation because the underlying risk factors still may have to be determined.

Deep vain thrombosis is a known cause of death during laparoscopic surgery. Despite early clinical recognition of risks and various prophylactic therapies like low molecular weight heparin, pneumatic stocking and spiral stocking of leg, still DVT remains surprise reason for death that can not be completely prevented during laparoscopic surgery.

Due to its connection to laparoscopic surgery and its sudden appearance, the forensic pathologist commonly investigates it to find out that it was a risk factor within the patient or it was a negligence of laparoscopic surgeon. The autopsy evaluation of a pulmonary embolism is enhanced by dissection of the leg veins with microscopical examination.

As the availability increases now a days in most of the forensic lab and the cost decreases, genetic testing will become a typical component of the evaluation of those deaths to find out genetic predisposition.

Laparoscopic surgeons still need fully define how this information may alter patient management; postmortem testing will give you valuable mortality data and also have a positive effect on the prevention of DVT in other patients.

Now once there is no autopsy done in case of your sister it is not possible to define the cause of death. As the DVT is a known cause of death in laparoscopic surgery the negligence of surgeon can not be established.

Therapeutic attempts in ICU once the patient developed DVT can modify autopsy findings in deaths caused by Pulmonary embolism. These ICU management include vigorous resuscitation and use of thrombolytic medicines, which may partially disrupt or displace the embolism just before death. So in this case how the real cause of death can be establishing.

That is really interesting and important fact. It is also fact that if thromblytic agents will be found in serum than it is proved that a good diagnosis was established by laparoscopic surgeon and an attempt was made y hospital to save the life of patient and so laparoscopic surgeon is not done any negligence. The death due to complications is not the responsibility of a medical professional. If every death will make doctor responsible then every laparoscopic surgeon or every doctor has to stop their practice.
